A Long Beach man already awaiting trial on charges that he embezzled funds from a county foster home was indicted last week on similar charges regarding a separate foster home, according to the Los Angeles County District Attorney’s Office.

Gary Batchelor, 64, pleaded not guilty to one felony count of misappropriation of public funds, forgery and embezzlement in a Grand Jury indictment, according to a release from the Los Angeles County District Attorney’s Office, issued today. If convicted, Batchelor faces up to eight years in prison.

Batchelor operates a tax accounting service in Long Beach, the release stated, and he allegedly stole nearly $200,000 from two group homes operated by the You Are the Difference Foundation.

Prosecutors claim Batchelor insisted he was paying federal and state payroll taxes for the nonprofit homes, which are located in Compton and LA and serve boys aged 12 to 18, but allegedly pocketed the money instead.

Batchelor was charged with co-defendant Steven Smith in the first case last year, where they were charged with embezzling more than $100,000 from Moore’s Cottage, between June 2011 and October 2013. Batchelor had been a board member and chief financial officer at Moore’s Cottage, and Smith was executive director.

A pretrial hearing has been set for April 22 at the Foltz Criminal Justice Center. The Public Integrity Division’s District Attorney Dana Aratani is prosecuting both cases.

This most recent case was investigated by the Long Beach Police Department, the Los Angeles County Department of Auditor-Controller, Office of County Investigations, the California Franchise Tax Board and the Los Angeles County District Attorney’s Bureau of Investigation.
