After the District Attorney rejected the case, the investigation continues into the July 27 accident that left one motorcyclist dead and another injured in the middle of busy Second Street. Charges have not been filed against the driver of an SUV that caused the accident. 

According to police, the incident occurred when McKenna’s On The Bay owner Nick Limer attempted to make an unsafe left turn directly in front of the motorcycles, who were passing through a green light. In the days following, Long Beach Police Department officials said they would be asking the District Attorney to consider criminal charges, most likely vehicular manslaughter.

The DA’s office rejected the case, however, indicating that there was no gross negligence that contributed to the accident and eliminating the possibility felony charges. The City Prosecutor’s office then returned the case to LBPD for additional investigation before filing any misdemeanor charges. 

“We don’t want to make any determination before we get all the facts,” said Assistant City Prosecutor Randall Fudge.

It is unclear whether the additional investigation is being used to determine what charges will be filed or whether charges will be filed at all.

Detectives say that alcohol was not a factor in the crash. Limer was questioned and released at the scene.
