Following the news that an environmental organization has filed a lawsuit against the Port of Long Beach in an attempt to appeal their settlement with the American Trucking Association, the lbpost.com spoke with City Attorney Robert Shannon on Tuesday afternoon to learn new details.

Shannon said that a hearing will soon be set for a State judge to hear the National Resources Defense Council’s lawsuit, which attempts to appeal an October lawsuit settlement between the Port of Long Beach and the American Trucking Association (ATA).

The NRDC contends that the settlement relinquishes too much of the Port’s power to regulate the Clean Trucks Program and could potentially allow older, polluting trucks to operate at the Port because of the eased restrictions. The Port has contended from the beginning that the new rules do not limit their ability to keep dirty trucks out.

Potentially, Shannon told the lbpost.com, a California Court judge could bring the matter to the Long Beach City Council, which would then decide whether the Port’s settlement with the ATA should be upheld.
