A retired Long Beach police sergeant is facing a misdemeanor charge that he was illegally carrying a concealed weapon when he accidentally shot himself in the ankle at a gas station, authorities announced today.

Jeffrey Garcia, 54, shot himself on June 26, according to police, which was one day after his name was spread across the internet when activist Shaun King accused Garcia and a handful of other retired police officers of participating in a Facebook discussion about killing King, who is an outspoken critic of police.

Now, Garcia could face up to a year in jail and a $1,000 fine if he’s convicted on the misdemeanor weapons charge, Long Beach City Prosecutor Doug Haubert said. If Garcia is found guilty, he could also be charged with a felony if he’s ever caught carrying a weapon without a permit again.

“Cases involving firearms are especially troubling and serious because the smallest mistake can result in death or great injury,” Haubert said. “In this case, the person carrying the firearm hurt himself. It could have been much worse for him or others.”

It’s common for former officers to have concealed carry permits, but Garcia—who retired from the LBPD in 2014—did not have one, according to Haubert. Reached by phone Tuesday, Garcia declined to say why he lacked a permit or go into detail about what happened.

He has a court date scheduled for next month where he’s expected to be arraigned. It’s unclear if he’ll face any further charged in connection with King’s allegations.

King said Garcia was part of a Facebook group where several former LBPD officers and other law enforcement employees talked about how they wanted to kill him.

Garcia reportedly wrote “Roger that,” when another former LBPD officer told him to “organize it jeff,” according to King.

Long Beach police say they’ve asked the FBI for help investigating King’s allegations. FBI spokeswoman Laura Eimiller confirmed the agency is assisting but said, at this point, no charges have been filed.
