The California Supreme Court refused Wednesday to review the case of a man convicted of fatally shooting a passerby in Long Beach nearly four years ago.

Jorge Luis Rodriguez is serving a 50-year-to-life sentence for the June 22, 2015, killing of Douglas Jerome Wilson Jr.

Rodriguez was convicted in November 2017 of first-degree murder, with jurors finding true an allegation that he personally and intentionally discharged a handgun during the commission of the crime.

Rodriguez—who was standing in an alleyway with two women—called Wilson a “fool” as the 37-year-old victim stepped out of his nearby apartment building, according to a Feb. 21 ruling by an appellate panel that rejected the defendant’s contention that there were errors in his trial.

Rodriguez pulled out a gun and fatally shot Wilson after the two women tried to diffuse the situation, according to the appellate ruling.

The victim was shot once in the stomach and once in the chest, then twice more—including a shot to the back—after falling to the ground.

Rodriguez was arrested just over a month later by Long Beach police.
